1. Overview of the law

The Utah Consumer Privacy Act took effect on December 31, 2023. It applies to businesses that earn at least $25 million a year in revenue and that process personal data of at least 100,000 Utah residents in a year, or earn at least half their revenue from selling personal data of at least 25,000 residents. The law is enforced by the Utah Attorney General and the Utah Division of Consumer Protection. SIE meets these thresholds and applies the UCPA in full.

2. Your rights

  • Right of access. Confirm processing and get a copy of your personal data.
  • Right to delete. Have personal data we hold about you erased.
  • Right to portability. Receive your data in a usable format.
  • Right to opt out. Stop targeted advertising and the sale of personal data.
  • No required right to correct. SIE still accepts correction requests as a courtesy.

3. How SIE complies

Utah uses an opt-out model for sensitive data. We give Utah residents a clear opt-out before processing sensitive categories, including racial or ethnic origin, religious belief, sexual orientation, citizenship status, medical or mental health information, genetic or biometric identifiers, and precise geolocation. We do not knowingly process the personal data of a child under thirteen without verifiable parental consent.

4. Authorized agents

The UCPA does not require us to honor authorized agents. SIE accepts authorized-agent submissions as a courtesy when they include a signed permission letter from you. We may still verify the request directly with you before acting.

5. How to submit a request

Or email [email protected] with the subject line "Utah UCPA Request".We respond within forty-five days.

6. Effective date and scope

The UCPA took effect on December 31, 2023, and applies to controllers meeting both the revenue and consumer thresholds. Personal data processed in a B2B or employment context is out of scope.
